Employment Tribunal decision published - Fri 30 Nov 2018

You may recall that at the end of April we brought to your attention a case taken to an Employment Tribunal, and involving an NAC member choir, Tideswell Male Voice Choir.

The case has today been officially published on the GOV.UK website, and is therefore now available in full for choirs to read. The reference is https://assets.publishing.service.gov.uk/media/5bfe8fb7e5274a0fd5f9fa2e/D_Kay_v_Tideswell_Male_Voice_Choir_Judgment.pdf

Choirs should note that during the summing-up the Judge specifically stated that the finding of employment was decided specifically on the circumstances of this case and this case alone, and that no precedent had been created. Thus while choirs and Musical Directors alike should be aware of the case and the decisions made, MDs should not automatically assume that they are employees.
